Terms & Conditions – Return Me Service

These Terms & Conditions (“Terms”) govern the use of the Return Me Service, a digital lost property recovery service provided under the Soluções Responsáveis brand and operated by FLASHIRRESISTÍVEL, UNIPESSOAL LDA (“the Company”, “we”, “our”, or “us”).
By accessing, registering for, purchasing, or using the Return Me Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

2. Definitions
For the purposes of these Terms, the following definitions shall apply:
2.1 Company: The Company refers to FLASHIRRESISTÍVEL, UNIPESSOAL LDA, the legal entity operating the Return Me Service under the Soluções Responsáveis brand.
2.2 Return Me Service: The Service refers to the complete digital ecosystem provided by the Company for assisting in the identification and recovery of lost property. The Service may include, but is not limited to:
- Smart QR identification products;
- Digital owner registration;
- Anonymous communication between Owners and Finders;
- Secure online management platform;
- White Label business solutions;
- Business integrations;
- Customer support services;
- Additional services introduced by the Company from time to time.
2.3 Smart Tag: A Smart Tag means any physical identification product supplied by the Company or its authorised partners, including key tags, stickers, cards, luggage tags, bicycle labels, pet identification tags, product labels, industrial identification solutions, or any other physical or digital identifier connected to the Service.
2.4 Owner: An Owner is any natural person or legal entity that has registered a Smart Tag or otherwise uses the Return Me Service.
2.5 Finder: A Finder is any person who discovers lost property carrying a registered Smart Tag and voluntarily uses the Service to assist in returning the property.
2.6 Business Customer: A Business Customer means any company, organisation, municipality, educational institution, sports club, association, event organiser or other legal entity using the Service for commercial or organisational purposes.
2.7 White Label Service: A White Label Service refers to a customised version of the Return Me Service offered under the Business Customer’s own brand, identity or commercial concept.
2.8 User: A User means any person accessing or using any part of the Service, whether as an Owner, Finder or Business Customer.
2.9 Website: Website refers to the official Soluções Responsáveis website located at https://solucoesresponsaveis.pt or any future official domains operated by the Company.
2.10 Content: Content includes any information, links, images, contact details, business information or other material that an Owner or Business Customer chooses to associate with a Smart Tag. The Owner remains solely responsible for the legality, accuracy and suitability of such Content.
3. Scope of the Service
3.1 Purpose of the Service: The Return Me Service has been developed to increase the likelihood of recovering lost property through secure digital identification while respecting the privacy of both Owners and Finders. The Service is designed to facilitate voluntary communication between parties in a responsible, secure and user-friendly manner.
3.2 Services Provided: The Company may provide, maintain and develop services including, but not limited to:
- Digital registration of Smart Tags;
- Secure owner identification;
- Anonymous communication between Owners and Finders;
- Management of Smart Tags and associated Content;
- White Label business solutions;
- Product integrations;
- API integrations;
- Business management tools;
- Customer support;
- Future digital services introduced by the Company.
The Company reserves the right to improve, modify, expand or discontinue individual features or services without prior notice where reasonably necessary.
3.3 Service Availability: The Company aims to maintain continuous availability of the Service. However, uninterrupted access cannot be guaranteed. Temporary interruptions may occur due to scheduled maintenance, software updates, security improvements, third-party service providers, telecommunications failures, force majeure events, or circumstances beyond the Company’s reasonable control.
3.4 Nature of the Service: The Return Me Service acts solely as a technological platform facilitating communication between Owners and Finders. The Company does not take possession of, transport, or verify ownership of lost property, nor act as an intermediary in disputes, or guarantee recovery. The decision to return lost property always remains entirely voluntary.
3.5 Responsible Use: The Service shall only be used for lawful and legitimate purposes. Users agree not to misuse the Service, impersonate others, provide false information, upload unlawful Content, or interfere with security. Any misuse may result in account termination.
3.6 International Operation: The Service may be used internationally, though availability of individual features may vary between countries.
3.7 Continuous Development: The Company continuously develops the Return Me Service, and features may evolve over time without constituting a breach of these Terms.
4. User Registration and Accounts
4.1 Eligibility: Users confirm they are at least 18 years of age or have legal authority to act on behalf of a minor or a legal entity.
4.2 Account Registration: Users agree to provide accurate, complete, current, and truthful information, keeping credentials up to date.
4.3 Account Security: Users are responsible for maintaining confidentiality of login credentials and preventing unauthorized access.
4.4 Responsibility for Registered Smart Tags: Each Smart Tag remains the responsibility of the registered Owner to ensure accuracy and lawful usage.
4.5 Multiple Smart Tags: Users and Business Customers may register and manage multiple Smart Tags under a single account.
4.6 Account Suspension or Termination: Accounts may be suspended or terminated for fraud, misuse, unlawful content, or violations of these Terms.
4.7 Account Deletion: Users may request account deletion at any time, subject to legal or regulatory data retention obligations.
4.8 Business Accounts: Business Customers may receive additional tools governed by supplemental commercial agreements.
4.9 No Transfer of Accounts: Accounts are personal and may not be transferred without prior written consent from the Company.
5. Smart Tags and Digital Identification
5.1 Purpose of Smart Tags: Designed to connect physical items with the digital platform via unique identifiers.
5.2 Ownership of Smart Tags: Purchasing a Smart Tag grants the right to use the Service, but does not transfer IP or software ownership.
5.3 Registration: Registration enables full management of linked content, contact details, and notifications.
5.4 Linked Digital Content: Users may link contact details, websites, media, product documentation, and promotional materials.
5.5 Responsibility for Content: Users are solely responsible for ensuring linked Content is lawful, accurate, and safe.
5.6 White Label Smart Tags: Customized branding and implementations are available for Business Customers under separate agreements.
5.7 QR Codes and Future Technologies: Currently QR-based; may expand to NFC, RFID, BLE, or digital wallets.
5.8 Availability of Linked Content: Continuous availability is targeted but subject to third-party and network factors.
5.9 Responsible Identification: Smart Tags must not be used for unlawful surveillance or deceptive tracking.
5.10 Continuous Development: Technologies and platform capabilities evolve continuously over time.
6. Responsibilities of Owners and Finders
6.1 Responsibility of the Owner: Must maintain accurate contact details and lawful content.
6.2 Responsibility of the Finder: Participation is voluntary; Finders are under no obligation to recover, store, or return items.
6.3 Privacy of Both Parties: Designed to keep personal contact details hidden unless explicitly authorized.
6.4 Lost Property: The Company never takes physical possession or custody of items.
6.5 Ownership Disputes: The Company does not act as an arbitrator in legal ownership disputes.
6.6 Accuracy of Information: The Company relies on user-submitted data and cannot guarantee its absolute accuracy.
6.7 Responsible Behaviour: Users agree to act respectfully and refrain from harassment or fraudulent acts.
6.8 Business Customers: Responsible for their own branding, customer communications, and product compliance.
6.9 No Guarantee of Recovery: Recovery depends on external factors; the Company cannot guarantee lost items will be returned.
6.10 Shared Responsibility: The platform relies on community cooperation and civic responsibility.
7. Liability and Limitation of Liability
7.1 Nature of the Service: Provided as a technology platform without outcome guarantees.
7.2 No Guarantee of Recovery: No explicit outcome or timeline guarantees are provided.
7.3 No Liability for Lost Property: The Company is not liable for theft, damage, loss, or recovery failures.
7.4 Third-Party Content: Not responsible for external linked websites or third-party services.
7.5 User-Generated Content: Users bear full responsibility for all published Content.
7.6 Technical Availability: Not liable for downtime caused by internet failures, cyber attacks, or maintenance.
7.7 Business Decisions: Business Customers accept full commercial risk for their operations.
7.8 Indirect Damages: Excludes indirect, consequential, or lost-profit damages to the fullest extent permitted by law.
7.9 Maximum Liability: Total liability is limited to the amount paid by the User for the specific product or service giving rise to the claim.
7.10 Good Faith: Operated in good faith to maximize recovery opportunities responsibly.
8. Privacy and Data Protection
8.1 Commitment to Privacy: Built on strong privacy protection principles.
8.2 Applicable Legislation: Complies with GDPR (EU 2016/679) and Portuguese data protection laws.
8.3 Data We May Process: Names, emails, phone numbers, language preferences, tag registrations, and technical logs.
8.4 Purpose of Processing: Operations, user communication, security, support, and legal compliance (never sold).
8.5 Data Minimisation: Collects only data strictly necessary for providing the Service.
8.6 Privacy by Design: Designed to minimize unnecessary personal information disclosure.
8.7 Security: Utilizes organizational and technical safeguards to protect user data.
8.8 Data Retention: Kept only as long as required for contractual, business, or legal requirements.
8.9 User Rights: Users hold rights to access, rectify, delete, restrict, or port their personal data.
